Terms of Service

These Terms of Service (“Terms”) govern your use of Konnie (the “Service”), an AI phone assistant that answers calls, sends and receives messages, and provides a web console for your business. By creating an account or using the Service, you agree to these Terms.

1. The Service

Konnie answers and places phone calls, handles text messages, books appointments, and organizes the resulting records on your behalf. Responses are generated in part by artificial intelligence. The Service is designed for business use by companies and self-managing property owners in the United States.

2. Accounts

You must provide accurate information and keep your sign-in credentials secure. You are responsible for activity on your account and for the people you authorize to use it. You must be at least 18 years old and able to form a binding contract.

4. Acceptable use

You may not use the Service to harass, defraud, or deceive; to send spam or unsolicited marketing; to impersonate others without authorization; to probe or disrupt the Service; or to build a competing product using the Service’s output.

5. AI output

AI-generated responses can be inaccurate or incomplete. The Service is not a substitute for professional advice (legal, medical, financial, or otherwise), and you should verify important information before relying on it. You remain responsible for decisions made in your business.

6. Third-party services

The Service interoperates with third-party services such as telephony carriers and Google integrations you choose to connect. Your use of those services is governed by their own terms, and we are not responsible for their availability or conduct.

7. Fees

Paid plans, prices, and included usage are described at the point of purchase. Fees are billed as stated there and are non-refundable except where required by law. We may change pricing with advance notice; changes apply from your next billing period.

8. Intellectual property

We own the Service, including its software and branding. You own your content and the business records generated for your account. You grant us the rights needed to operate the Service on your behalf, as described in our Privacy Policy.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms, create legal risk, or fail to pay fees, with notice where practicable. Sections that by their nature should survive termination do survive (including Sections 5, 8, 10, 11, and 12).

10. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that every call or message will be captured or delivered. The Service does not support emergency calls: it cannot place or route calls to 911 or other emergency services. Do not rely on it in an emergency.

11. Limitation of liability

To the fullest extent permitted by law, Konnie will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months before the claim arose, or one hundred U.S. dollars if you have not paid us.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law, including communications and recording-consent laws.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Dallas County, Texas, and each party consents to their jurisdiction and venue.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Konnie regarding the Service. Neither party is liable for delay or failure caused by events beyond its reasonable control.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and adjust the effective date; material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.
